These Terms of Service (“Terms”) govern your access to and use of Motify, including our mobile application, website, AI image generation features, subscription features, credit-based features, and related services (collectively, the “Service”).
By creating an account, accessing, downloading, subscribing to, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You may use the Service only if you are legally allowed to do so under applicable law. The Service is not intended for children.
If you create an account or use the Service on behalf of another person, business, organization, or brand, you represent that you have authority to do so.
We may refuse access, suspend accounts, or request additional confirmation where required to comply with applicable law, app-store rules, platform rules, safety requirements, or fraud-prevention measures.
Motify provides AI-assisted image processing, visual concept generation, and photo enhancement for motorbike-related use cases.
The Service may allow you to upload motorbike photos, reference images, prompts, or instructions in order to receive generated outputs. Features may include, but are not limited to:
The Service is intended for visual inspiration, creative editing, entertainment, and photo enhancement. It is not professional vehicle design, engineering, mechanical, road-safety, repair, inspection, legal, registration, insurance, or roadworthiness advice.
You may need to create an account to use some or all features of the Service. You agree to provide accurate and current information and to keep your login credentials secure.
You are responsible for activity that occurs under your account unless caused by our failure to take reasonable security measures.
You must notify us if you believe your account has been accessed without permission.
We may suspend or terminate your account if you violate these Terms, misuse the Service, attempt to bypass limits, abuse free trials, interfere with the Service, fail to pay applicable fees, or use the Service unlawfully.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own lawful purposes.
The Service is licensed, not sold. You may not:
Certain features of the Service may require a paid subscription, one-time purchase, credit purchase, or other in-app purchase.
Motify may offer subscription billing cycles that include, for example:
The exact pricing, currency, billing period, included features, generation limits, and offer terms presented at the time of purchase will apply.
If you start a free trial, your subscription may automatically convert into a paid subscription unless you cancel before the end of the trial period.
Subscriptions automatically renew unless canceled before the renewal date.
Billing, renewals, cancellations, and refunds are generally handled through the app store or platform through which you purchased the subscription. You can manage or cancel your subscription in your relevant app store account settings.
Deleting the app, deleting your account, or stopping use of the Service does not automatically cancel an active subscription. You must cancel the subscription through the applicable app store or payment provider.
The Service may limit the number of free or paid AI generations available per day, week, month, subscription period, account, device, or payment method.
Generation limits, credits, processing speed, model availability, queue priority, output quality, resolution, and feature access may vary depending on your plan, region, device, platform, technical conditions, and our operational needs.
Unless stated otherwise in the app:
We may refuse, delay, throttle, or block generations if we detect abuse, excessive usage, automated usage, fraud, payment issues, policy violations, provider restrictions, or attempts to bypass limits.
Except where required by applicable law or the rules of the platform through which you purchased the subscription or in-app purchase, fees are generally non-refundable once charged.
If you believe you are entitled to a refund under applicable law or platform policy, you should use the refund procedures of the relevant app store or contact support at motify.application@gmail.com.
Cancelling a subscription usually stops future renewal charges but does not automatically refund the current billing period. After cancellation, you may continue to access paid features until the end of the current billing period, unless otherwise stated by the platform, plan, or applicable law.

Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.
“User Content” means any content you submit, upload, input, or otherwise provide through the Service, including photos, images, reference images, prompts, text, and instructions.
You retain ownership of your User Content.
However, you grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, modify, and display your User Content solely as necessary to:
This license ends when your content is deleted from the Service, except to the extent retention is required for backups, legal compliance, dispute resolution, fraud prevention, accounting, or security purposes.

You are responsible for keeping your own backups. We are not required to store, preserve, or restore User Content unless required by law.
The Service uses artificial intelligence systems to process User Content and generate outputs. AI processing may occur on remote servers and may be performed by us or by trusted third-party service providers.
By using AI features, you understand and agree that your uploaded content, prompts, reference images, instructions, and related information may be transmitted to and processed by third-party infrastructure or AI providers solely as needed to provide the requested Service.
We do not use your User Content to train third-party AI models unless we clearly disclose this and obtain consent where required by law.
AI processing may be subject to the technical limitations, availability, policies, and terms of our infrastructure providers, app stores, payment providers, subscription tools, storage providers, analytics providers, authentication providers, and AI model providers.
“Generated Output” or “Output” means images, edits, variations, or other content generated by the Service based on your User Content, prompts, reference images, instructions, or selected features.
As between you and Motify, and to the extent permitted by applicable law and third-party provider terms, we assign to you any rights we may have in the Generated Output created specifically for your request.
You are responsible for reviewing Generated Output before relying on it, sharing it, publishing it, selling it, or using it in commercial or personal projects.
We do not guarantee that Generated Output is unique, non-infringing, accurate, realistic, safe, lawful, commercially usable, technically feasible, road-safe, compatible with your actual motorbike, or fit for any particular purpose.
Because AI systems may generate similar or identical content for different users, Generated Output may not be exclusive to you.
You must not use Generated Output in a way that violates laws, infringes rights, misleads others, or creates a false impression that an image is real when disclosure is legally or ethically required.
You agree not to use the Service to upload, generate, request, distribute, or share content that:

We may review, block, remove, or refuse to process content where we believe it violates these Terms, platform rules, provider policies, applicable law, or safety requirements. We are not required to monitor all content.
Motify is intended for inspiration, concept generation, visual ideation, and photo enhancement.
The Service does not provide mechanical, engineering, safety, legal, registration, insurance, roadworthiness, vehicle inspection, repair, parts-fitment, or professional design advice.
Generated Outputs may be inaccurate, incomplete, unrealistic, unsafe, unlawful, or unsuitable for real-world implementation. A visual modification shown in an Output may not be mechanically possible, road-safe, legal, insurable, compatible with your motorbike, or available for purchase.
Before making real-world modifications to a motorbike or other vehicle, you should consult qualified professionals and comply with applicable laws, regulations, safety standards, inspection requirements, and insurance requirements.
We are not responsible for damage, injury, failed inspections, failed purchases, legal penalties, insurance issues, unsafe modifications, or other losses caused by relying on AI-generated visual concepts.
The Service may rely on third-party providers and platforms, including analytics, authentication, cloud infrastructure, AI providers, subscription tools, payment processors, storage providers, customer-support tools, and app stores.
Your use of certain third-party services may also be subject to their terms and policies.
We are not responsible for third-party services, websites, terms, policies, outages, actions, failures, pricing, availability, billing decisions, or refunds, except as required by law.
If you downloaded the Service from the Apple App Store, Google Play, or another app store, you acknowledge that:
The Service may include links to third-party websites, tools, marketplaces, products, shops, parts, accessories, or other resources.
We do not control or endorse third-party websites or products. We do not guarantee product availability, pricing, compatibility, legality, fitment, safety, quality, delivery, or suitability for your motorbike.
Any transaction with a third party is solely between you and that third party. You are responsible for verifying parts, accessories, services, laws, and safety requirements before purchase or use.
The Service itself, including its software, branding, design, text, graphics, interfaces, workflows, logos, icons, and other non-user content, is owned by or licensed to Motify and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Service.
You may not use our name, logo, branding, app name, screenshots, interface, or other proprietary materials without our written permission, except where allowed by law.
Feedback, suggestions, ideas, bug reports, and feature requests that you provide may be used by us without restriction or compensation, unless otherwise required by law.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and share information.

If there is a conflict between these Terms and the Privacy Policy regarding the processing of personal data, the Privacy Policy controls for that issue.
You may request account deletion through Settings > Delete account, if available, or by contacting us at motify.application@gmail.com.
Deleting your account may remove or disable access to your account data, uploaded content, generated images, history, credits, and app settings, subject to technical, legal, security, fraud-prevention, accounting, dispute-resolution, and backup retention requirements.
Account deletion does not automatically cancel active subscriptions purchased through Apple, Google, or another payment provider. You must cancel those subscriptions directly through the relevant platform.
We may suspend or terminate your access to the Service, with or without notice, if:
You may stop using the Service at any time.
After termination, your right to use the Service ends immediately. We may delete or disable access to your account, User Content, Generated Outputs, credits, and related data, subject to applicable law and our Privacy Policy.
Termination does not affect provisions that by their nature should survive termination, including provisions relating to payments already due, user content licenses needed for legal or backup purposes, intellectual property, disclaimers, limitation of liability, indemnity, and dispute-related terms.
We may modify, update, suspend, limit, replace, or discontinue all or part of the Service at any time, including features, AI models, generation limits, credit systems, pricing, free usage, trial availability, supported platforms, output formats, and subscription plans.
We do not guarantee that the Service will always be available, uninterrupted, secure, timely, error-free, or compatible with all devices or operating systems.
The Service may fail, produce errors, experience delays, or become unavailable because of maintenance, outages, third-party providers, AI model capacity, app-store restrictions, internet connectivity, or other technical reasons.
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.
We disclaim, to the maximum extent permitted by law, implied warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

To the maximum extent permitted by law, Motify and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, subscription value, device functionality, vehicle value, or other losses arising out of or related to the Service.
To the maximum extent permitted by law, our total liability for claims arising out of or relating to the Service will not exceed the amount you paid us for the Service during the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
To the extent permitted by law, you agree to indemnify and hold harmless Motify and its operator from claims, losses, liabilities, damages, costs, and expenses arising out of:

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, website, email, app-store listing, or other reasonable means.
Continued use of the Service after updated Terms become effective means you accept the updated Terms.
If you do not agree to updated Terms, you must stop using the Service.
You may not assign or transfer your rights or obligations under these Terms without our written permission.
We may assign, transfer, subcontract, or delegate our rights and obligations under these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, business transfer, or operation of the Service, where permitted by law.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be interpreted or replaced to the extent necessary to make it valid and enforceable while preserving its original intent as much as possible.
These Terms, together with the Privacy Policy and any additional terms shown in the app or at purchase, form the entire agreement between you and us regarding the Service.
If any additional purchase, subscription, promotion, platform, or feature-specific terms conflict with these Terms, the more specific terms apply only to that specific purchase, subscription, promotion, platform, or feature.
These Terms are governed by the laws of the Czech Republic, excluding conflict-of-laws rules.
Any disputes arising out of or in connection with these Terms or the Service will be submitted to the competent courts of the Czech Republic, unless applicable consumer law provides otherwise.
Before starting a legal claim, you agree to contact us first at motify.application@gmail.com so we can try to resolve the issue informally.
If you are a consumer, you may have mandatory rights under the laws of your country of residence, and nothing in these Terms limits those rights.
